This is a NON-SMOKING house. 4. DAMAGE/RESERVATION DEPOSIT- A damage/reservation deposit refundable. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, refundable after departure, provided the following provisions are met. a. No damage is done to home or its contents, beyond normal wear and tear. b. All debris, rubbish and discards are placed in trash cans. c. All keys are put back into the locked system and the home is left locked. Please be sure to check back doors. d. All charges accrued during the stay are paid prior to departure. e. No linens are lost or damaged. f. The renter is not evicted by the owner (or representative of the owner), or the local law enforcement. g. No furniture, fixtures, linens, pots, pans, cups, glassware are damaged or missing. h. There is a $50 charge for any furniture moved from room to room and not placed back in its original place. Everything has a cost associated with it and will be charged for if it is found missing or damaged. This is only to compensate us for having to find a replacement or repair the damaged item. i. No vehicles are parked in the back yard. There is designated for parking for vehicles. k. Outside lights are not kept on all night and not left on during the day l. Any tampering of outside surveillance cameras will be an immediate eviction with NO return of money. Please note the surveillance cameras are outside only. 5. INCLUSIVE FEES - Rates include a one-time linen-towel setup. Amenity fees are included in the rental rate. 6. NO DAILY MAID SERVICE - While linens and bath towels are included in the unit, daily maid service is not included in the rate. We do not permit towels or linens to be taken from the house. 7. FALSIFIED RESERVATIONS - Any reservation obtained under false pretense or number of Guest is greater than the number of Guest indicated and paid for will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in and/or may be evicted from the home with no return of monies. 8. WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance. 9. No 3rd party rental the party booking the rental is the party staying. Not able to book rental for someone else. The person reserving must be in the home. 10. Any tampering of outside surveillance cameras will be an immediate eviction with NO return of money. Please note the surveillance cameras are outside only. 11. No events or parties are allowed on the property without written permission from owner. Amount of Guest on the property is indicated when reserving property. 12. The house is not child proof all minors should be supervised in and outside of the property. Guest takes full responsibility of minors in their party and do not hold owner(s) responsible for any unforeseen liability. 13. Certain websites allow reviews that are unchecked with regard to reasonable sentiment. Guest agrees that even minor unreasonable negative sentiment can unjustly cause damages to owner's future business. Therefore, Guest accepts and is hereby notified that we do not participate in reviews from websites that are not owned or controlled by us and the business transaction between all parties should remain private. This Paragraph is a material provision this agreement. All communications related to this transaction shall remain private. Specifically, Guest and invitees agree not to criticize, make any statement which disparages or post any review on any website unless requested in writing by us. If any review is posted by Guest or invitee thereof, and found to contain unreasonable negative sentiment in the sole opinion of the website and is not removed within 72 hours (the Review), Guest agree that a copy of this rental agreement shall serve as Guest full authorization to request and oblige 3 the third party or website hosting or displaying the Review to remove it promptly upon request by owner/rental team. Failure to remove the Review will be considered a breach of this Agreement, and owner/rental team will consider this act to have irreparable harmed by loss of business and goodwill due to violation of this provision. In this event, Owner and/or rental team will seek damages of up to $10,0000 from Guest and Guest agree to pay all such damages requested by Owner and or Rental team, upon written demand, Guest will pay any additional legal fees necessary to enforce demand should Guest not comply. 14. Waiver, Release And Hold Harmless Agreement In consideration of permission granted by Property Owner(s) of said property allowing Rental Guest(s) to rent a house for a specific amount of time, I, understand that my participation and/or involvement in renting property for vacation with my Guest and/or Family and/or Friends carries with it the potential for certain risks, some of which may not be reasonably foreseeable, including any pets. I further acknowledge that these risks could cause me, or others around me harm, including, but not limited to, bodily injury, damage to property, emotional distress, or death. I am a willing participant in rental of said vacation house rental as indicated in attached rental agreement and agree to be responsible to my Guest, Family and/or Friends. I waive all claims against any of the Released Parties for any injuries, damages, losses or claims, whether known and unknown, which arise during or result from my and/or Family, and/or Friends and/or Guest participation in staying on the premises of the vacation rental property that I have rented, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties. Which arise during or result from my participation in the staying or renting of the vacation rental, including any associated overnight stay, regardless of whether or not caused in whole or in part by the negligence or other fault of the Property Owner(s) of the said property as indicated in the confirmation. I release and forever discharge the Released Parties from all such claims. I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any By Signing Below or making payment, I agree to all terms and conditions of this agreement, I agree to release, indemnify, and hold harmless Property Owner(s), as well as all employees, agents, representatives, successors, etc. from all losses, claims, theft, demands, liabilities, causes of action, or expenses, known or unknown, arising out of my and/or my Family, and/or my Friend and/or Guest participation in attendance of renting a vacation rental house. I have carefully read and reviewed this Waiver, Release And Hold Harmless Agreement.
