By booking your stay at 7040 Gates Road, Gates Mills, OH 44040, you agree to be subject to the following Tenant Rental Agreement:
You (Hereinafter the "Tenant"), and S. A. Langmack Co. (Hereinafter the “Owner”) agree to the following terms concerning the rental of the property located at:
7040 Gates Road, Gates Mills, OH 44040
with exclusive use of the designated bedroom or bedrooms
and shared use of the common areas of the house and exterior grounds (Collectively hereinafter the "Premises"),
but excluding entry or use of non-booked bedrooms, the caretaker’s quarters, the basement, the garage attic and the garage parking area unless as specified.
THAT for and in consideration of the covenants, contract, terms, provisions and conditions herein set forth, including but not limited to, Owner’s rental of the Premises to Tenant, the parties do hereby mutually agree, each with the other, as follows:
Rental of the Premises by Owner to Tenant (the term Tenant as used herein shall include multiple tenants in a single booking party as the circumstances dictate).
Arrival and departure dates are as booked through Airbnb.
Occupancy and Documentation
Single bedrooms are to be occupied by no more than 1 person at a maximum. Double bedrooms are to be occupied by no more than 2 people. Booking Tenant shall be 18 years of age or older. Minors may be part of a booking group, but under no circumstances are minors to be the sole occupant or occupants of the Premises. Minors staying at the Premises MUST be accompanied by an adult. The Premises are not “child proofed”, therefore, it is incumbent upon the booking Tenant to provide appropriate supervision at all times to any minors in the booking group.
Photo identification shall be provided by booking Tenants.
Check-In : 4PM Check-Out : 11AM ( If you require, check with Owner about changing these times. )
Please understand that Owner wants you to check-in to a properly cleaned suite. Thanks for your adherence to this policy; unless otherwise agreed to in writing, including email and text message. Tenant shall vacate the Premises no later than the checkout time on the departure date. Failure to depart the suite prior to the agreed check-out time on the date of your departure will result in a late checkout charge of $50.00.
Keys and Initial Entry using Lock Box House Key at the Front Door
At time of arrival, Tenant shall find a house key in the Lock Box for which Tenant shall have the combination. Tenant shall return the lock box house key to the lock box after using it.
Upon entering the Premises, Tenant shall find set of keys to the house and individual bedrooms in the drawer of the front foyer table. Each set will contain 2 keys: a specific room key (1, 2, 3, 4, or 5) and a house key. Under no circumstances shall Tenant make a copy of either key nor shall a Tenant lend a key to another person. Tenant will be charged $10.00 for the first replacement room key; the fee to the Tenant for subsequent replacement of room keys shall be double the previous replacement room key cost. Because the “house key” is made from an exclusive, non-duplicable key blank, the loss of the house key will necessitate changing the front door lock and replacement of all house keys. Owner shall charge Tenant $225.00 for any lost house keys.
At time of departure, all keys are to be returned to the drawer in the front foyer table. The cost to replace any unreturned keys is detailed above.
After Tenant’s initial entry, Owner may change the lock box combination.
Payments and Cancellation Policy
The all Fees and Security Deposit payment is due at the time of booking. Owner reserves the right to refuse entry to a Tenant not fully paid at time of arrival. Payments shall be made through the AirBnB website.

If Tenant believes appropriate, Owner recommends the purchase of Red Sky Trip Cancellation and Travel Insurance or similar travel insurance.
The driveway on the Premises is sufficiently large to park 8 cars in an orderly fashion. It is expected that the Tenant will undertake to park his/her car leaving parking room for the other Tenants and in such a manner so as not to “block in” or “block-out” another car either from the driveway or from the garage.
Non-heated, covered garage parking may be available for rent at the discretion of the Owner on a first-come-first-served basis. Fees for covered garage parking are as follows: $5./car/day; $25./car/week; $75./car/month.
At the time of booking, Tenant shall notify Owner of the intention of bringing a pet or pets. Pets shall be allowed at the Premises only with the advance approval of the Owner. Tenant accepts all responsibility for any pet or pets brought on the Premises and all liability for damages more than the $300.00 security deposit caused to the Premises by the pet or pets. Tenant shall also assume all responsibility imposed on pet owners under the laws of the State of Ohio and the ordinances of the Village of Gates Mills. For example, Village of Gates Mills requires that dogs be under direct control of the owner at all times.
Owner has the right to check on the pet at any time the Tenant pet-owner is not present. The Tenant shall dependably clean-up after the pet, including collection and proper disposal of the pet wastes in an outdoor container for deposit of pet waste, provided by the Owner. Tenant’s violation of the provisions of this Section, as determined solely by the Owner, will necessitate removal of the Tenant’s pet or the removal Tenant and pet and forfeiture of full rental.
Use of the Premises
Tenant shall use and maintain the Premises in a careful and lawful manner. Tenant may invite guests to visit. All guests of the Tenant shall responsibility of the Tenant. The premises may be used by the Tenant for a party, social gathering, meeting or the like, as defined by 15 to 30 people in attendance, including the tenants, for which the Owner will charge the Tenant a $35. “Small Party Fee”, where more than 30 people are in attendance, the Owner will charge the Tenant a $65. “Large Party Fee”. Party over 60 people is prohibited without prior written approval. In all cases, the Tenant shall leave the Premises in a clean condition, exclusive of the towels and linens, the laundering of which are the sole responsibility of the Owner. Tenant shall pay for maintenance and repairs should the Premises or personal property therein be damaged or lost during Tenant’s occupancy. Tenant agrees that the Owner may deduct costs of said repairs or special housekeeping services from the Security Deposit prior to refund. Tenant understands that any damages to the Premises or personal property therein which are discovered to exist, or which occur during the Tenant occupancy, should be reported at the earliest possible time to the Owner.
Tenant shall pay for any damage done to the Premises over and above normal wear and tear. Tenant agrees that the Owner may deduct costs of replacement or repairs from the Security Deposit prior to refund if Tenant causes damage to the Premises or its personal property.
Tenant occupy and use the Premises at its own risk. Tenant assume responsibility and all risks associated with various aspects and items on Premises, including but not limited to the sidewalk/walkways, terrace, deck, porch, outdoor swing, kitchen, bathrooms, appliances and Tenant shall take adequate safety precautions at all times including the salting of outdoor icy paths, stairs and walkway and treading carefully and requesting from the Owner additional salt before “running-out”.
Tenant shall exercise reasonable use of the Premises including but not limited to visitation by Tenant’s guests, noise, and courteous treatment of the other Premises tenants, use of electricity, natural gas, water, and the barbeque grill LP gas.
No Smoking and Designated Smoking Area
There shall be NO SMOKING at the Premises except in the designated Smoking Area. NO SMOKING AREAS SHALL INCLUDES THE TERRACE, DECK, PORCH, GARAGE AND HOUSE. Tenant smoking anywhere except the designated smoking area shall be grounds for immediate termination of this Agreement, upon which Tenant shall immediately vacate the Premises. Owner shall not be liable for the refund of any rents or deposits for termination pursuant to this section.
Cigar, cigarette and pipe smoking shall be allowed only in the designated Smoking Area, which shall be defined as the open field (not in the woods) across the bridge and run-off creek away from the house. All smoking materials shall be completely extinguished, cleaned-up and deposited in the designed trash can in the smoking area. Leaving a mess on the ground may result in a deduction from your security deposit. Smokers please note: that in the winter and during rain storms and severe weather smoking may be very difficult because this is an open field without shelter of any kind.
Departure Instructions, Bed Linens, Towels, Supplies
Bed linens, blankets, pillows, and towels are provided, along with a starter supply of shared hand soap, shared dish soap, shared dishwasher detergent, paper towels, and bathroom tissue. If additional cleaning is needed after your check out, any items that are damaged or missing (including linens), or furniture repositioned, you will be charged for the additional cleaning service and/or missing items. Tenants are responsible for removing from the refrigerator or cabinets all open food brought into the house by the Tenant, loading dirty dishes into the dishwasher and running it, placing garbage in the outside receptacles or garbage chutes. Please do not dispose of food belonging to any tenants staying at the Premises who are not members of your booking party. Do not remove bed spreads or mattress pads and do not remake the beds.
Additional Terms and Conditions
Should Tenant violate any of the terms of this Agreement, Owner, at its discretion, may terminate Agreement immediately and Tenant shall immediately vacate the Premises. Owner shall not be liable for the refund of any rents or deposits for termination pursuant to this section.
Owner shall not be responsible for providing any additional furnishings or equipment not presently in the Premises.
Owner has the right to inspect the Premises at reasonable hours without prior notice at any time to enforce the terms of this Agreement. Repair Personnel may enter the Premises at reasonable hours for the purpose of necessary repairs and inspections.
Tenant shall not sublet the Premises.
TENANT AGREES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS OWNER AGAINST ANY AND ALL CLAIMS, DEMANDS, LIABILITY, LOSS OR EXPENSE OF EVERY KIND AND NATURE, INCLUDING REASONABLE ATTORNEYS FEES AND OTHER EXPENSES OF LITIGATION, BECAUSE OF ANY INJURY TO OR DEATH OF PERSONS OR DAMAGE TO PREMISES (INCLUDING TENANT’S PROPERTY) WHICH OCCUR AS A RESULT OF THE NEGLIGENCE OF THE TENANT RESULTING FROM THE USE OF THE PREMISES OR BY REASON OF TENANT OR ITS INVITEES BEING PRESENT ON THE PREMISES, REGARDLESS OF OWNER FAULT OR NEGLIGENCE OR STRICT LIABILITY, EXCEPT TO THE EXTENT THE TOTAL LIABILITY, LOSS OR DAMAGE IS ATTRIBUTABLE TO AND CAUSED BY THE SOLE AND EXCLUSIVE NEGLIGENCE OF THE OWNER, OR EXCEPT TO THE EXTENT AS LIMITED BY APPLICABLE LAW.
Tenant expressly recognizes that any insurance for property damage or loss maintained on the Premises does not cover the personal property of Tenant, and that Tenant should purchase insurance if any such coverage is desired.
Tenant agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by Owner in enforcing this Agreement. All actions under law shall take place in Cuyahoga County, Ohio.
Tenant expressly acknowledges and agrees that this Agreement is for transient occupancy of the Premises, and that Tenant does not intend to make the Premises a permanent residence or household.
Valuable items left behind by Tenant will be held for the Tenant and reasonable effort will be made to contact the Tenant for return. If items are not claimed after 2 months, they shall become the property of the Owner. The Owner shall not be held liable for making provision for the return of the Tenant’s property, or the condition, loss of, or damage to said items.
Tenant’s failure to occupy the Premises in accordance with the laws of the State of Ohio will result in Owner’s immediate termination of the Agreement and Tenant’s forfeiture of rent and security deposit.
This Agreement represents the entire understanding and agreement between the parties hereto and supersedes any and all prior terms, conditions, understandings, or contracts, whether written or oral, that may exist between the parties regarding the rental of the Premises.
The provisions of this Agreement are severable, and if any clause or provisions hereof shall be held invalid or unenforceable in whole or in part, then such invalidity or unenforceability shall not affect any other clause or provision in this Agreement.
Any waiver by either party of any provision or condition of this Agreement shall not be construed or deemed to be a waiver of any other provision or condition of this Agreement, nor a waiver of a subsequent breach of the same provision or condition, unless such waiver is expressed in writing and signed by the parties. Delay in the enforcement of any remedy in the event of a breach of any term or condition, or in the exercise by either party of any right, shall not be construed as a waiver of such remedy or right.
BY BOOKING THIS RESERVATION, YOU HAVE AGREED TO ABIDE BY ALL OF THE TERMS SET FORTH ABOVE.
