The home has ocean views, is walking distance to the beach, restaurants and dining, nightlife, and family-friendly activities. You’ll love my place because of the comfy bed, the coziness, and the kitchen. My place is good for couples, solo adventurers, business travelers, and families. The property was fully renovated so the kitchen, bathrooms and furnishings are all new. You can walk to the Trolley which can take you into Laguna Beach and you can also walk to Dana Point shops and restaurants.
Tenant must abide by community rules. No hanging of towels or bathing suits on railings or outdoor spaces.
This document shall operate as the Agreement to Lease Condo located at 34136 Selva Road, Dana Point, California, 92629. The Lessor (Designer Properties LLC) does hereby agree to grant to the Lessee rental of vacation property.
In addition to the rental fee listed above, Lessee will provide Lessor with a $500.00 security deposit. Provided that Lessor’s real and personal property are in the same condition as when occupancy commenced and all terms of this agreement are met, the $500.00 security deposit will be returned within thirty (30) days of your departure. If non-incidental damage to the property occurs, Lessor has the right to retain some or all of the security deposit.
The standard cleaning fee is $300.00 and payable by Lessee. The cleaning fee provides for three hours of general housekeeping and linen services once you depart the unit. In the event extra services are required (excessive laundry, excessive sand, excessive dish washing, etc.), then additional charges may be deducted from the security deposit at the rate of $50 per hour.
PAYMENT OF RENTAL FEE:
A 50% deposit is required with this agreement in order to hold your reservation. This deposit is not refundable if the reservation is cancelled. The balance of the rental fee, cleaning fee and security deposit is due 60 days prior to your vacation arrival. If full payment is not received at least 60 days prior to your arrival, then your reservation will be cancelled and you will forfeit your deposit paid.
CAUSE FOR IMMEDIATE TERMINATION OF AGREEMENT & VACATING OF PREMISES:
The following will result in the tenants and all other occupants to vacate the premises upon request and to completely forfeit the rental fee and the security deposit.
Exceeding occupancy. Maximum occupancy rate is 6.
Use of property for any illegal activity.
Smoking in the unit. (NO SMOKING ALLOWED)
Having pets or animals in the unit.
Any damage to the premises or complex.
Any other acts which interfere with neighbors’ right to their quiet enjoyment of
AGREE TO HOLD HARMLESS:
Lessor does not assume any liability for loss, damage, or injury to Lessee, their guests, or their personal property. Neither does Lessor accept liability for any inconvenience arising from any temporary defects or interruption in the supply of water, gas, electricity, or plumbing. Lessor does not accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or reasons beyond our control. The Lessee, for himself/herself, his/her heirs assignors, executors, and administrators fully releases and discharges Lessor from any and all claims, demands, causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of or in connection with the occupancy of the premises and agrees to hold Lessor free and harmless of any claim or suit arising there from.
CLIFFS, HOT TUB, PATIOS & NOISE:
Tenant hereby acknowledges that a large section of the beachfront on the West Coast is covered with various rocks and cliffs. Tenant assumes all risks by going to the beach and Lessor is not liable for any accidents occurring therein. Tenant hereby acknowledges that the hot tubs, swimming pools and patios/decks as part of the reserved property can be dangerous, slippery when wet, and that injury is likely to occur to anyone who is not careful. Tenants should observe and adhere to all rules and policies as posted on the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of the hot tubs, pools, and patio/deck areas. The pool and hot tub area is gated and requires a key for entry. The loss of the pool key will result in a $150 fine that we must pay our HOA to replace lost keys. Lessor cannot be held responsible for any pool closures for maintenance or any other reason as these decisions are out of the Lessors control.
The rental unit is a lower unit and there are occupants in the upper unit. Lessee understands and accepts that noises from the adjacent units are possible and enters into this agreement with full knowledge of this fact.
ADDITIONAL TERMS AND CONDITIONS:
This lease constitutes the entire agreement between the parties. No changes shall be made herein except by writing, signed by each party and dated. The failure to enforce any right or remedy hereunder, and the payment and acceptance of rent hereunder, shall not be deemed a waiver by either party of such right or remedy in the absence of a writing as provided for herein.
In the event legal action is required to enforce any provision of this Agreement, the Lessor shall be entitled to recover reasonable attorney's fees and costs.
Lessor and Lessee agree that this agreement is a binding legal obligation.
Check-in time is 4:00 pm, and Check-out time is 10:00 am; please plan travel accordingly. Late check-outs are not permitted and will result in the loss of the security deposit. Our cleaning crew needs the full time allotted to prepare the home for the next guests.
Any cancellation of a reservation will result in the loss of the 50% deposit. Full payment is due (60) days prior to arrival. If payment is not received (60) days prior to arrival then the reservation will be cancelled and will result in the loss of the 50% deposit. Cancellations or changes that result in a shortened stay, that are made within (60) days of the arrival date, forfeit the full payment. Early departure does not warrant any refund of rent or deposit.
