THIS HOME IS CURRENTLY FOR SALE AND THERE MAY BE HOME IMPROVEMENTS SCHEDULED THAT ARE OUT OF OUR CONTROL. WE WILL DO OUR BEST TO MAKE SURE IT IS NOT DURING YOUR STAY.

1.CONDITION OF PREMISES. Tenant stipulates, represents and warrants that Tenant will examine the Premises within 1 (one) hour of taking possession and unless giving immediate notification, acknowledge that they are at the time of this Lease in good order, repair, and in a safe, clean and tenable condition.
2.ALTERATIONS AND IMPROVEMENTS. Tenant shall make no alterations to the buildings or improvements on the Premises, including, but not limited to, move any furniture, fixtures, decorations or the like. Tenant may not remove any item(s) from the property.
3.UTILITIES. On a monthly rental, tenant(s) shall be responsible for paying all utility services required on the Premises during their stay. Unless other arrangements are made. For a weekly rental, $35/wk are included and anything over that amount the tenant(s) are responsible to pay.
a.MAINTENANCE AND REPAIR; RULES: Tenant will, at its sole expense, keep and maintain the Premises and appurtenances in good and sanitary condition and repair during the term of this Agreement and any renewal thereof. Without limiting the generality of the foregoing, Tenant shall:
Keep all lavatories, sinks, toilets, and all other water and plumbing apparatus in good order and repair and shall use same only for the purposes for which they were constructed. Tenant shall not allow any sweepings, rubbish, sand, rags, ashes, paper towels, condoms, feminine products or other substances to be thrown or deposited therein. The house utilizes a lift station and any foreign objects other than toilet paper and human waste can and will damage the pump. Any damage to any such apparatus and the cost of clearing stopped plumbing resulting from misuse shall be borne by Tenant;
Deposit all trash, garbage, rubbish or refuse in the locations provided therefore and shall not allow any trash, garbage, rubbish or refuse to be deposited or permitted to stand on the exterior of any building or within the common elements. Excessive waste will require a dump fee to be paid by the tenant as we only have one large garbage can.
b.FURNITURE: The furniture in the home is very high-end. Please treat it as such. Do not place any hot items on the counters, tables or any other furniture or fixture without the proper heat resistant material. Do not place any cold beverages on the tables without a coaster. Do not move any furniture (patio furniture included). Damage to any of the furniture can far exceed your security deposit in which case you will be responsible for the balance.
c.LAWN: Do not drive or park on the lawn. Please refrain from using the lawn for recreational activities such as volleyball.
d.HOUSE GUESTS: The rental fee for this agreement was based on the wear and tear expected by the total number of occupants you declared in your party on page 1. It is for this reason we limit additional “company” or “guests”. The number of house guests any tenant shall have at any one time is limited to four (4) including children. All house guests are expected to leave no later than 11:00pm with only the tenants (number of occupants disclosed on page 1 of this contract) remaining/sleeping in or on the premises. A fee of $200 per person will be deducted from your security deposit for each person discovered staying on the premises above the number declared on page 1 of this agreement even of for only one night. ABSOLUTELY NO HOUSE PARTIES, POOL PARTIES OR CEREMONIES OF ANY TYPE PERMITTED!
e.CLEANING OR MAINTENANCE EQUIPMENT: Items kept on the premises for maintenance or repair reasons are not to be touched by the guests. Such items as the riding lawn mower, weed eater, tools, vacuum cleaner, carpet steam cleaner and other miscellaneous items are strictly off limits to the tenants. Use of the washer and dryer are permitted but should be used in a reasonable manner with no sandy or excessively garments placed therein.
f.FLOORING: Take extra care so as not to spill any beverages or food items on the carpet. The tile area provides adequate space for consuming items of that nature. Take extra care not to drag anything across the floor that may mar or scratch the floor surface. As moving furniture is prohibited please do not drag any other items across the floor that may damage the carpet. Be sure to rinse the chlorine from the pool or spa off of your person in the bathroom that is closest to the pool deck. The chlorine from the pool and spa will bleach the carpets.
g.GENERAL USE PROVISIONS: Please use all facilities, appliances, furniture, exercise equipment and other household items with care. Feel free to use the gym as it is there for that purpose but please put the weights back on the appropriate rack when finished. The Aquarius is a NO SMOKING FACILITY. Smoking is prohibited in or about the immediate area of the home. Any smoking done in the general area of home will require all cigarette buttes to be disposed of in an outside waste can. Please set air conditioning thermostats to 82 degrees upon checking out. Please check to make sure all water consuming items (faucets, toilets, etc) are not left running as well.
h. POOL RULES: Tenants are to rinse their person before entering the pool or spa to avoid introducing any foreign chemicals to the pool or spa. To prevent slipping or falling, do not run around the deck of pool. Pool is shallow is not safe for diving; tenants are not to dive in the swimming pool. Please ensure that all toys and/or small objects are removed from pool. Please do not throw any debris into pool or catch basin behind pool (i.e. coins, rocks, and shells) to avoid causing damage to swimming pool pumps and pool equipment. If there are any problems with the pool or spa equipment, tenants are to contact Sam Guirguis, Landlord/Owner. Tenants are not to handle pool equipment on side of house or change any of the settings or valves. No furniture of any type is to be put in the pool or on the sundeck of the pool. Tenants may adjust pool features from the outside control system located on the side of the spa only. Tenants are not to use the digital key pad located inside the house next to the glass siding door or the system will require re-programming, the expense of which shall be born by the tenant.
5.CANCELLATION: If a confirmation is cancelled sixty (60) days prior to the arrival date, we will refund one hundred (100) percent of the total reservation deposit, less the booking fee of $45 and a $150 cancellation fee. If a confirmation is cancelled less than sixty (60) days, you will forfeit your reservation deposit. If less than sixty (60) days and due to an unforeseen circumstance you will need to provide documentation showing the emergency along with a written statement of cancellation only then will a full refund of your reservation deposit be considered.
6.ATTORNEY’S FEES: In the event of litigation relating to the subject matter of this Agreement, the non-prevailing party shall reimburse the prevailing party for all reasonable attorney fees and costs resulting there from.
7. SEVERABILITY: If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.
