This Renter Agreement ("Agreement") is made and effective ("Agreement Date") Brandon Andrews ("Owner") and ("Guest") regarding the property("Rental Property") which is located at:
412 12TH Ave SE
Rochester, MN 55901
In consideration of the rent received and the mutual promises contained herein, Owner of the Rental Property does hereby lease and rent to Guest(s) such Rental Property under the following terms and conditions:
1.Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property. Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses. The kitchen appliance, dishes, pots and pans need to be clean and put away for the next guest at time of check-out. The house needs to be left in clean condition after check-out. Linens, beddings and towels are washed by the Owner. Tenants shall pay for excessive cleaning, maintenance and repairs should the premises be left in a lesser condition. The tenants agree that the Landlord shall deduct costs of said services from the security deposit prior to refund if the property is left in lesser condition than at arrival. Cleaning costs will be billed separat and charged directly to the credit card without further permission of the card holder with a rate of $25 per hour.
2.A security deposit is required ("Security Deposit") See AirBnb terms and condition at the time of your reservation.
3.The linens and towels are supplied with Rental Property and Guest is responsible for lost or damaged items at the cost of two (2) times the published standard rental price for such damaged or lost linens or towels.
4.There is no daily housekeeping service. Tenants are required to maintain the house clean themselves and wash linens and towels as needed. Linens and towels do NOT needs to be washed at time of check-out.Upon request and agreement a housekeeper can come regularly to clean during the tenants rental period for a surcharge of $25 per hour.
5.Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind.
6.In no event shall the Rental Property be occupied by more persons than guests signed up at time of booking or as stated in the confirmation letter, without prior approval by Owner. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall Guests assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair. If listed "For Sale", Guests agree to grant access by scheduled appointment upon notification.
7.There shall be no smoking inside the premises. Smoking is permitted outside the home.
8.No refunds will be provided due to inoperable appliances. The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of god or nature.
9.Cable TV is provided and the service package has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service. Tenant shall not purchase movies or extended services over the cable box without prior agreement and payment to Landlord.
10.High-speed wireless Internet is provided as a convience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to Internet service.
11.Guest is responsible for all shipping costs for any Lost and Found items that Owner is requested to return to Guest. Items found and not claimed within 30 days will be disposed of at the discretion of Owner.
12.The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. Quiet hour starts at 10 PM and outdoor noise should be kept to a minimum.
13.In the event Owner is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by Owner, Guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability. The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired.
14.The property has a fire extinguisher installed in the kitchen. The fire extinguisher was fully charged at last inspection. It is the duty of the tenant to inform management immediately should the fire extinguisher become less than fully charged. Tenant agrees to use the fire extinguisher only for true emergencies.
15.The property has fire alarms installed and they are believed to function properly at the time of rental. Tennant will notify management without delay if a fire alarm “chirps” or has a low battery condition.
16.Tenant shall see to their own security while in the property by locking doors, windows, garage doors, etc. when it’s prudent to do so.
17.Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.
18.Agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement. Owner shall conduct all brokerage activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any Guest.
NOW, THEREFORE, in consideration of the mutual agreements and covenants herein contained, Guest has read and agreed to the following:
I am over the age of 18 and assume responsibility for those in my charge under the age of 18. I hereby assume all legal responsibility for bodily injury to me or to any person on the property as a result of my visit and use, operation or possession of equipment hired or loaned to me. Acknowledging this, I accept complete responsibility for the minor children and myself in my charge and visit the property and equipment and engage in activities or events at my own risk.
I will abide by the rules and accept these rental conditions:
•The property I rent will be returned in the same condition in which it was rented and I will be responsible for all damage and/or loss that occurs during my rental period.
•I acknowledge receipt of the property in good and clean order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree to check-out with the property being in clean condition, kitchen dishes, appliance and other items are cleaned and put back in cupboards.
•I acknowledge that the Owner will charge any excess cleaning costs directly on my credit card with no further permission needed within 14 days after check-out. Cleaning fees are $25 per hour.
•I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not.
•I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented.
•I enter into agreement freely with the Owner of the Rental Property at my own risk, acknowledging the risks inherent in outdoor activities and assume any and all responsibility for the minor children and myself in my charge.
•All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations.

This fit our needs exactly. It was our daughter's wedding and we had family coming out of state. It was a great place to come back to and visit with our relatives.

PROS: Brandon was great to work with, very responsive and flexible. All necessities were provided (TP, dish soap, paper towels, laundry detergent, etc.) which was great. The house was VERY clean. CONS: The house is old and worn in some places. For instance, the bathtub finish is very chipped. There were no outlets in the upstairs bath and only 1 in the main bath. Neighbors across the street and next door were a little sketchy, but we didn't have any issues with them.

I stayed hear with 10 other members of my family for a week and it couldn't have been better. The house is great and is stocked with everything you might need. There is a good-sized backyard that includes a fire pit. When we asked Brandon where we could buy some wood for a fire he went into the garage and just gave us a stack of firewood. That's just one example of how accommodating Brandon was for us. He really went the extra mile for us during our stay. I would definitely recommend staying here and I will stay here in the future if I return to Rochester.

We are a younger couple that is college educated and work full time. We decided to rent our primary residence full time after friends and friends started staying here when in town for Mayo Clinic appointments. We are excited to offer this beautiful home to travelers of all walks of life.
