Rental Policies and Agreement and House Rules:

These additional terms apply to all our accommodations in addition to the standard Airbnb Terms and Conditions:

This Rental Agreement is made by and between the Guest, the owner of the Accommodation (“Owner”), either directly or through VIP Resort Properties, LLC, its authorized leasing agent (Rental Manager), a Florida corporation which specializes in vacation rental reservations, each, a party, collectively, parties. This Rental Agreement and all exhibits, linked pages and attachments referenced below, as well as the Airbnb Terms, which by this reference are incorporated herein as though full set forth are, together, the Agreement.

SECURITY DEPOSIT: Airbnb will put a hold on your credit/charge card or debit card account for $500 which is only charged in the event of damage to the Accommodation that occurs during your stay. The security deposit/hold is required and is NOT applied toward the rental fees. This deposit/hold will be held by Airbnb in accordance with the Airbnb Terms and Conditions. No charges will be made against this deposit provided there has been no damage to the Accommodation, its contents, the facilities and grounds and provided that the Accommodation is not excessively dirty thereby requiring extra cleaning procedures. If damage to the Accommodation, its contents and/or the facilities and grounds exceed the amount of your deposit/hold, you agree to pay such charges in full and hereby authorize Airbnb to charge any such amounts to your charge or debit card.

Unless Guest experiences Extenuating Circumstances as defined in the Airbnb Terms and Conditions, no refunds will be made for illness, injury, or travel delays for any unused nights resulting from early checkouts or for any other reason including inclement weather.

HURRICANE POLICY: Refunds for unused days will only be issued in the event of a MANDATORY evacuation. Cleaning fees, bed taxes, resort fees and sales taxes are not refundable once a unit is occupied. If a mandatory evacuation is ordered within 72 hours of your check in date, a full refund will be made. No refunds will be given for any reason for nights evacuated on MONTHLY Reservations.

CLEANING FEES: IF UPON ARRIVAL, you have ANY HOUSEKEEPING PROBLEMS with the unit assigned, report them to the Rental Manager IMMEDIATELY so that they may be rectified. NO DISCOUNTS WILL BE GIVEN DUE TO HOUSEKEEPING MATTERS.

If the condition of the Accommodation following such rental term requires extra cleaning beyond standard cleaning services, Guest shall be solely responsible for the cost of such cleaning, and Guest hereby authorizes Airbnb to retain such amounts from the security deposit held by Airbnb or affirmatively charge such amounts from Guest’s charge or debit card on file with Airbnb, as the case may be.

RESTRICTIONS: The maximum number of guests in a rental unit is limited by the number and types of beds in a unit. Occupancy may not exceed the number of people included in the reservation. Occupancy calculations include infants and children. If maximum occupancy is exceeded, you may be required to check-out immediately.

The Rental units are to be used for residential purposes only. No weddings, banquets or commercial activities are permitted without the prior written approval of Rental Manager, and the Condominium Homeowners’ Association, Any unauthorized use, illegal activity or disturbance of the peace will result in eviction and forfeiture of all rents and deposits.

ACCESS TO UNITS: If your Accommodation has a keyed entry, you will be assigned a 4 digit lockbox code to enter the unit. The lockbox will be placed on the door of your condo at 4:00 p.m. on the date of your check-in. The lockbox will contain 2 keys for use during your stay. THERE IS A $50.00 LOST KEY FEE FOR EACH KEY LOST DURING YOUR STAY. If your Accommodation has keyless entry, you will be assigned a 6 digit access code. The code will be activated at 4:00 p.m. on the date of your check-in. If you arrive early and if the unit has been cleaned and inspected, we may allow early access. However, we make no representations about unit availability and access before check-in time.

CHECK-IN/CHECK-OUT: Check-in time is 4:00 p.m. or later. In some instances, access to your unit may be unavoidably delayed due to cleaning or maintenance issues. THERE WILL BE NO DISCOUNTS OFFERED DUE TO A LATE CHECK-IN. For those arriving after office hours, arrangements should be made prior to arrival for check-in information. YOU MUST CALL OR EMAIL THE RENTAL MANAGER, IN ADVANCE DURING NORMAL OFFICE HOURS TO ARRANGE FOR AN AFTER HOURS CHECK-IN AND TO GET GATE, ELEVATOR AND UNIT DOOR ACCESS CODES.

Check-out time is no later than 10:00 am on your scheduled departure date. All keyless entry Accommodations electronic access codes will deactivate at 10:00 a.m. on the date of your check out. There shall be no holding over or late departure without prior approval of the Rental Manager. Any unauthorized holding over by Guest by more than 30 minutes shall be subject to an extra day’s rent, plus any damages incurred including, but not limited to, the cost of alternative housing for other guests displaced by Guest’s holding over.

PETS: GUESTS ARE NOT ALLOWED TO HAVE PETS IN ANY RENTAL UNIT OR ON PRINCESS PREMISES AT ANY TIME. If a pet is found in a unit or on the condominium property, you will be responsible for a full carpet/furniture cleaning, flea spray, damages, loss of $500 deposit and immediate eviction and no refund for unused nights.

REQUESTING SPECIFIC UNITS: The Rental Manager will use commercially reasonable efforts to comply with all reservation requests for specific units. However, due to owner changes, removal of units from the program, or mechanical problems, WE CANNOT GUARANTEE a specific unit or bedding. In the event a unit you requested is removed prior to arrival or is otherwise not available, Rental Manager will notify you within 48 hours of learning of same.

In the event that a unit you are renting is for sale, Rental Manager may need to show the property during your visit. We will make every effort to schedule the showing at a convenient time for Guest so as to not disturb your stay. Rental Manager will not allow anyone access to the unit in these circumstances unless Guest consents and, if Guest is not able to be at the unit, Rental Manager will have a representative present at the time of such access.

EQUIPMENT AND APPLIANCES: All units have heating/air conditioning, refrigerators, washers and dryers, stoves and microwaves, dishwashers and in some cases ice machines. Rental Manager cannot guarantee the performance of these or other appliances. We will take commercially reasonably measures to have any malfunctioning appliances or heating and air conditioning units repaired as soon as possible. There will be no refunds or adjustments on rent should a problem arise with any such appliance or equipment.

INITIAL SET-UP: An initial complimentary issue of toilet tissue, bath soap, trash bags, dishwashing soap and dishwasher detergent will be furnished. However, any subsequent replacement will be the guest’s responsibility. Bath towels and bed linens are provided with your rental. Please supply your own beach and pool towels

REQUIREMENTS: Since our property caters to families, we DO NOT accept reservations for anyone under the age of 26. Anyone under the age of 26, unaccompanied by a parent, will not be permitted to register or stay in the Accommodation and will be subject to forfeiture of deposit, rental fees, resort fees, cleaning fees and taxes paid. We require that for every 3 guests under 26 years of age (Responsible Party), there shall be 1 person 26 years of age or older in the Accommodation. The Responsible Party/Guest must remain on property throughout the stay or eviction and forfeiture of deposit, rental fees, cleaning fees and taxes paid will occur. Any reservation obtained under false pretenses will be subject to forfeiture of all deposits, rental fees, cleaning fees and taxes paid and the party will not be permitted to register.

COMPLIANCE WITH RULES: If you are evicted from the unit which you are renting for failure to abide by these rules or for any other reason, you will not be entitled to a refund of the deposit, rental fees, resort fees, cleaning fees and taxes paid in advance. You will also be responsible for damages to the unit or condominium property caused by you or your guests. In the event the cost to repair any damage to the condo unit, its amenities and its contents exceeds the amount of your deposit, you hereby authorize Airbnb to charge your charge card or debit card account for any such excess and you agree to pay such charges in full.

PROPERTY DAMAGE AND THEFT: We assume no responsibility for any loss or theft of guest’s personal property or items left behind in units on the beach or in the common areas of the property. Rental Manager assumes no liability for theft or damage to guest property, vehicles, boats, motorcycles, bicycles or any other items left in or on them. If you leave items behind when checking out we will take commercially reasonably efforts to ship them to you at your expense.

GUEST SAFETY: THERE ARE NO LIFE GUARDS ON DUTY EITHER ON THE BEACH OR IN THE SWIMMING POOL AREAS. SWIM AT YOUR OWN RISK! For your safety, we request you observe the posted Pool Rules and Ocean Condition Flags maintained on the beach by Bay County. Pool Rules forbid glass containers, bottles, diving or jumping or horseplay in or around the pools.

DO NOT FEED WILDLIFE FROM THE BALCONIES AND DO NOT THROW ANYTHING OFF THE BALCONIES. ANYONE CAUGHT THROWING ANYTHING OFF A BALCONY WILL BE SUBJECT TO IMMEDIATE EVICTION AND FORFEITURE OF YOUR SECURITY DEPOSIT, RENTAL FEES, FEES, RESORT FEES, CLEANING FEES AND TAXES PAID. YOU MAY ALSO BE SUBJECT TO PROSECUTION.

SMOKING POLICY: Violation of our NON-SMOKING policy by smoking in a unit will result in a recovery fee equal to the $500 Security Deposit and subject you to eviction. You hereby authorize Airbnb to charge such amounts on your charge card or debit card and you agree to pay all such charges.

SUB LEASING IS NOT ALLOWED UNDER ANY CIRCUMSTANCES. Anyone determined in the Rental Manager’s sole discretion to be subleasing will be subject to eviction and forfeiture of your deposit and all rental fees paid.

BEACH RULES: We want all of our Guests to enjoy our beach. Therefore, to facilitate our Guests’ enjoyment, we encourage our Guests to temporarily set up on the beach their own beach chairs, umbrellas, and sun canopies/tents. With respect to canopies/tents set up on the beach, we require that they be set up on either side of the beach rental chairs but NOT between the rental beach chairs and the Gulf. Alternatively canopies/tents can be set up on the beach between the sand dune and the rental beach chairs. Bay County regulations (aka, Leave No Trace Law) require that you remove canopies/tents from the beach at dusk each night and upon your departure. Such items may be stored on the beach at the base of the sand dune, at your own risk. Any items left on the beach away from the dune after dusk are subject to removal and disposal by Bay County. VIP Resort Properties, LLC, will not be responsible for loss, damage or destruction to any items left on the beach.

ALCOHOLIC BEVERAGES:
Effective March 1, 2016, no alcoholic beverages may be consumed on the sandy beach area DURING THE MONTH OF MARCH. Violation of this law may result in citation or arrest.

INTERNET USAGE AGREEMENT: The Condominium Homeowners’ Association, Inc. provides free wireless internet access at various locations on the premises. This is an unsecured network and by logging on to their system, you agree that you are using the system at your own risk. The Rental Manager, and Condominium Homeowners’ Association, Inc., and each of their owners, members, directors, and employees make no representations and warranties whatsoever about the speed, reliability, security, or any other aspect of this system. The Condominium Homeowners’ Association and Rental Manager will cooperate with all authorities in any investigation or inquiry that they may make in connection with the use of our internet system for any illegal purpose. You expressly agree to hold the Rental Manager and the Condominium Homeowners Association, and each of their owners, members, directors, officers and employees harmless and you agree to indemnify them for any costs, expenses, or damages arising from the use of this system.

CHECK OUT PROCEDURES: Please load the dishwasher, empty the refrigerator and dispose of all trash and garbage in the trash chute on each floor situated near the east stairwell. Please let us know when you have checked out.

INDEMNITY: Personal Property and Injury - Guest`s personal property, including vehicles, are not insured by Owner, Rental Manager the Condominium Homeowners’ Association or Airbnb against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner and Rental Manager do not insure against personal injury to Guests, their invitees or licensees for any reason. Guest agrees to indemnify, defend and hold harmless Owner, Rental Manager and Condominium Homeowners’ Association from all claims, disputes, litigation, judgements, costs and attorney fees resulting from loss, damage to or injury to Guest, their invitees or licensees or their personal property. Guest shall defend, indemnify and hold harmless each of Owner and Rental Manager, Condominium Homeowners’ Association, and their respective agents, owners, affiliates, subsidiaries, directors, officers, shareholders, employees, assigns and insurers against any claim, action, liability, loss and expense, including reasonable attorneys` fees and related costs (collectively "Loss") relating to or arising out of Guest`s and/or its guests` breach of this Agreement or violation of any applicable federal, state, local or association law, ordinance, rule or regulation (together, "Law").

LIMITATION OF LIABILITY: EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT, NEITHER RENTAL MANAGER NOR OWNER MAKES ANY WARRANTIES TO GUEST OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. NEITHER RENTAL MANAGER NOR OWNER WARRANTS, AND NEITHER SHALL BE LIABLE, TO GUEST OR ANY THIRD PARTY FOR ANY UNAVAILABILITY OR INOPERABILITY OF RENTAL MANAGER’S SERVICES, TELECOMMUNICATIONS SYSTEMS OR THE INTERNET, TECHNICAL MALFUNCTION, COMPUTER ERROR, CORRUPTION OR LOSS OF INFORMATION, OR OTHER INJURY, DAMAGE OR DISRUPTION OF ANY KIND TO PERSON OR PROPERTY ARISING FROM EVENTS BEYOND THE REASONABLE CONTROL OF RENTAL MANAGER, THE OWNER AND/OR THE CONDOMINIUM HOMEOWNERS’ ASSOCIATION, IN NO EVENT SHALL EITHER RENTAL MANAGER OR OWNER BE LIABLE TO GUEST FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF SAVINGS OR LOSS OF BUSINESS OPPORTUNITY, EVEN IF SUCH DAMAGES ARE FORESEEABLE AND WHETHER OR NOT SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. EACH OF RENTAL MANAGER’S AND OWNER`S MAXIMUM AGGREGATE LIABILITY HEREUNDER SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY GUEST TO RENTAL MANAGER UNDER THE RENTAL AGREEMENT.

DISPUTES; In the event of a dispute between the GUEST, OWNER or RENTAL MANAGER arising out of or relating to this Agreement, including with respect to any Accommodations or sums billed, collected and/or distributed hereunder, the parties shall first attempt to resolve the dispute through informal good faith negotiations entered into promptly upon the request of a party. In connection with such process, each party shall share all information relating to such matter reasonably requested by the other party. In the event such dispute is not successfully resolved within 30 days of the parties` initial dispute resolution conversation then any such dispute shall have exclusive jurisdiction and venue in Bay County, Florida, County or Circuit Court.

PRIORITY; WAIVER; CONTROLLING LAW; ETC.: In the event of any inconsistency between the terms of this Agreement and the Airbnb Terms, the Airbnb Terms shall prevail. No modification of any Accommodation shall be binding unless in writing (email confirmation is acceptable) issued by an authorized representative of Rental Manager, Owner and/or Guest, as the case may be, with written, affirmative acceptance and approval of such modification by an authorized representative of the other parties (electronic signature or email confirmation are acceptable). No waiver of any right or obligation under this Agreement shall be binding unless in writing signed by the party to be bound. If any provision herein is held to be unenforceable, the remaining provisions shall remain in full force and effect. All rights and remedies hereunder are cumulative. Affirmative acceptance of a reservation to stay at the Accommodation shall constitute Guest`s binding agreement to and acceptance of these terms, including without limitation, this Agreement. This Agreement shall be governed by the laws of the State of Florida (without regard to its conflict of law provisions) all actions arising from or relating to this Agreement shall be brought exclusively in the state courts situated in Bay County, Florida. All parties agree to a waiver of a jury trial. No terms, provisions or conditions of any email, acknowledgment or other writing or form that Guest may use, or any handwritten changes or notations by Guest on a Rental Manager or Owner-provided form shall serve to alter, modify or have any effect on the terms of this Agreement and the parties` resulting rights and obligations.

MODIFICATION: Reservation Agent may modify any of the provisions of this Agreement, at any time in its sole discretion, by posting a new Agreement on Airbnb. Unless otherwise provided in the revised Agreement, the modified terms shall take effect immediately when posted. Rental Manager shall use commercially reasonable efforts to notify Guest in advance of any such modifications, provided it shall remain Guest`s duty to review the Agreement from time to time to inform themselves of the provisions and requirements thereof. IF ANY MODIFICATION IS UNACCEPTABLE TO GUEST, GUEST`S SOLE AND EXCLUSIVE RECOURSE AND REMEDY IS TO CEASE USE OF THE SERVICES. GUEST`S CONTINUED USE OF THE SERVICES FOLLOWING THE MODIFICATION OF THE AGREEMENT SHALL CONSTITUTE GUEST`S BINDING ACCEPTANCE OF AND AGREEMENT TO THE AGREEMENT AS MODIFIED.

Everything was very nice, just as the pictures and description described. The location was perfect, close enough to everything but far enough to be out of the crowd. Perfect for families or a couple! Cory, the beach guy was very friendly and helpful. From check in to check out, the staff were wonderful! I would definitely stay here again! Thanks for a wonderful, memorable vacation!!
